Business Entertainment: When Can You Actually Claim Tax Relief?

When it comes to business entertainment, HMRC’s rules are often misunderstood. Most business owners assume that any form of entertaining — whether it’s lunch with a client or taking a team out for drinks — is automatically a business expense. However, in most cases, entertainment costs are not tax deductible. That said, there are a few important exceptions, and understanding them can help you stay compliant while maximising what you can claim.

At Yorkshire Accountancy, we help businesses across Hull, Cottingham and beyond navigate the grey areas of tax relief — including those involving business entertainment.

❌ What Counts as “Entertainment” — and What Doesn’t

Surprisingly, there’s no strict legal definition of “entertainment” for tax purposes. HMRC interprets it broadly — generally any hospitality or gift that is provided free of charge with the aim of building goodwill or relationships.

Here’s a basic rule of thumb: if your business wouldn’t have incurred the cost without the guest being present, it likely counts as entertainment — and the expense will be disallowed for tax and VAT purposes.

🔍 Example:
If you take a customer out for lunch, the full cost is considered business entertainment. Even though you (as the director or employee) ate too, HMRC sees your meal as incidental to the guest’s, and none of the cost is allowable.

✅ When Business Entertainment IS Allowed

Now, for the good news. There are three main areas where business entertainment can be tax-deductible:

1. Employee Entertainment

If you’re treating your employees — such as a team social, summer BBQ, or Christmas party — this is classed as employee entertainment, and it can be deductible, so long as it meets certain criteria.

For example, if you invite all employees to a staff party, even if directors and their partners also attend, the event may still qualify for tax and VAT relief. However, if the event is only for directors or non-employees (like clients or family), then relief is unlikely to apply.

💡 There’s also a £150 per head annual exemption for staff functions. So, if your business throws a party for employees and keeps the cost under this threshold, it may also be exempt from being treated as a benefit-in-kind.

2. Contractual Entertainment

In rare cases, business entertainment can be allowed where it’s part of a contractual obligation — that is, if your business is receiving something of equal or measurable value in return.

A good example would be hospitality included in a service package sold to clients. If a client pays for a conference and refreshments are included as part of the paid offering, that can be allowable, because it’s considered part of the trade.

That said, the return value must be clear and genuine. HMRC will not allow expenses where the return is nominal — for example, giving a meal in exchange for someone filling in a feedback form wouldn’t meet the standard.

3. Light Refreshments at Business Meetings

This is a lesser-known exception. HMRC allows tax relief for light refreshments — like tea, coffee, water, and biscuits — provided at business meetings or events, so long as they’re not excessive and the purpose is clearly business.

🧾 VAT Considerations

VAT rules largely mirror income tax rules when it comes to entertainment. If the entertainment is disallowed for income tax, it’s generally non-recoverable for VAT too. However, for employee entertainment (where qualifying), VAT can typically be reclaimed.

Be cautious with mixed events (where employees and non-employees are present). In those cases, VAT can only be claimed on the proportion related to employees.

📂 Record Keeping Matters

HMRC expects businesses to clearly document any entertainment expenses:

  • Names of those entertained
  • The business purpose
  • Invoices and receipts
  • A breakdown of employee vs. guest costs (for VAT)

These records should be retained for at least six years, and they’re your best defence should HMRC raise any queries.

🧠 Final Thought from Yorkshire Accountancy

Navigating the rules around business entertainment isn’t always black and white. Many expenses feel “business-related,” but that doesn’t mean they’re deductible.

If in doubt, it’s best to ask — we’re always happy to review your records and advise whether a particular expense is allowable. At Yorkshire Accountancy, we make the complex feel simple.
